Use of the Polaris Art website is subject to the following Terms and Conditions of Use:
Customer acknowledges agreement with these Terms and Conditions of Use as well as agreement with our Privacy Policy by their placing an order to purchase art or any other item for sale, including Member Artist services, on the Polaris Art website.
All sales shall be deemed to have been made in the State of New Hampshire, United States of America, regardless of the location of the Customer. The Customer agrees that any dispute with Polaris Art arising from a Customer's purchase from Polaris Art shall be brought by the Customer exclusively in the state or federal courts situated in the State of New Hampshire. The Customer also hereby agrees that such venue is appropriate and that Polaris Art's agreement to sell to the Customer is dependent on this provision.
(a) Prices are listed on Polaris Art's website, and are subject to change without notice.
(b) Payment is due before shipment.
(c) Polaris Art shall not be liable for handling or customs charges for shipments outside of the United States.
All items for sale are shipped directly by the Member Artists per our Shipping Policy. Polaris Art notifies Member Artists with item details along with complete shipping information once payment has been received and funds deposited. All Member Artists have agreed to ship their items via a method that provides for tracking of the shipment.
Returns must be authorized by Polaris Art and are subject to our Returns Policy and the Member Artist Return Policy, if such policy exists. In any case, artwork to be returned must be returned free of any damage and be in original and saleable condition.
Member Artists may have a Return Policy that covers their individual items. A Member Artist's Return Policy will be clearly indicated in the individual Member Artist's 'About the Artist' section within their personal gallery pages if such policy exists.
(a) Polaris Art warrants that it has the proper authority to represent and sell the items on our website on behalf of the individual Member Artists.
(b) Polaris Art does not warrant the aesthetic or material quality of any item, but merely passes through to the Customer whatever warranty the Member Artist provides for their respective items.
(c) Polaris Art DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED BY LAW, INCLUDING MERCHANTABILITY AND USE FOR A PARTICULAR PURPOSE.
Polaris Art makes every effort to ensure the accuracy of the information on its website. However, the information published may contain typographical errors or inaccuracies. If an error is made and an item is listed at an incorrect price, Polaris Art shall maintain the right to refuse or cancel any order placed at the incorrect price. If the order has been confirmed and charged to your credit card, Polaris Art shall immediately issue a credit in the amount of the incorrect price and contact you with corrected pricing information should you still wish to purchase the item in question.
The Member Artists at Polaris Art attest that the artwork in their individual galleries is their own and that it in no way infringes upon the copyrighted materials of any other person or entity.
These Terms and Conditions of Use along with our Privacy Policy represent the complete and final agreement between the Customer and Polaris Art for the matters set forth herein.
(a) These Terms and Conditions of Use and any transactions made under them shall be interpreted by and be subject to the laws of the State of New Hampshire.
(b) In the event any section or portion of a section of these Terms and Conditions of Use are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms and Conditions of Use, and the remaining terms shall continue in full force and effect.
(c) Polaris Art shall not be responsible for damages or delays resulting from natural disasters, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo.
(d) Polaris Art reserves the right, at any time, to modify, alter, or update its Terms and Conditions of Use, and you agree to be bound by such modifications, alterations, or updates.
